Policy on Use of Ninja Tune Works for AI Purposes

For full clarity and without affecting previous rights reservations, Ninja Tune (including Ninja Tune Limited, Just Isn’t Music Limited and all associated companies) expressly affirms that its rights are fully reserved as set out below.

Ninja Tune affirms that any past, present or future access, use, copying, reproduction, extraction, distribution or exploitation of any of the works or content (or portion thereof) owned or controlled by Ninja Tune (including recordings, audiovisual recordings, compositions, lyrics, artwork, images, data, metadata, etc.) for the purpose of text and data mining, artificial intelligence training, development or commercialisation of AI systems, tools or technology, web scraping, mining, altering, making extractions, preparing derivative works or similar purposes, and by any means, is prohibited, except as specifically and expressly licensed by Ninja Tune in the form of a written license. The use of any artist name, image, likeness and voice also requires specific permission.

All rights to make reproductions and extractions for text and data mining purposes in relation to all works, content or other subject matter referred to in Article 4(1) of Directive EU 2019/790 on copyright and related rights in the Digital Single Market are, have been, and continue to be – in respect of Ninja Tune works or content – expressly reserved to Ninja Tune pursuant to Article 4(3) of that Directive. For each jurisdiction outside of the European Union, Ninja Tune similarly reserves all rights to use Ninja Tune works or content for AI Purposes regarding any applicable exception, in each case to the fullest extent permitted by applicable law.

For the avoidance of doubt, our reservation applies to all works or content owned or controlled by of Ninja Tune, now or in the future, including where this content may be identified through publicly available means. Further, no such right or license is to be implied under any circumstances in any part of the world. No party that has lawful access to any Ninja Tune works or content for any other purpose (e.g., the operation of a music streaming service) is authorised to use those works or content for AI Purposes without a separate license in advance from Ninja Tune.
